On December 29, 2010 the Ministry of Finance issued Circular 216/2010/TT-BTC governing the issuance of a list of items (including materials used for feed production, feed, fertilizers and pesticides) whose import-related value added tax (VAT) payment deadline is to be extended temporarily.
According to the circular, in cases where an import designed for being used as feed cannot be differentiated from products that were designed for a different purpose, the related customs authority requires customs declarer(s) to show documents proving that the import was bought to be used as feed and then extends the deadline to pay VAT subject to the import according to law.
Enclosed with this circular is a list of items including materials used for feed production, feed, fertilizers and pesticides whose import-related VAT payment deadline is temporarily extended.
This circular will take effect on February 15, 2011. Items stated in the list attached to this circular, whose import cargo manifests were registered when and after Circular 128/2010/TT-BTC took effect on October 10, 2010 and tax related to which is not yet paid, have their import-related VAT payment deadline extended in accordance with Circular 216/2010/BTC and Circular 128/2010/TT-BTC./.
